Parts & Service Credit Application

We (I) understand that your terms are net 30 days, payable by the 10th of the month following statement. We (I) further understand that if our (my) payment is not received by your office by due date, a delinquent charge at the rate of 1.5% per month (annual percentage rate of 18%) will be added to the outstanding balance

White's Tractor & Truck/White's International Trucks reserves the right to limit purchases and serve requests and the right to place our (my) account on COD should our (my) line of credit be exceeded and/or account payments are not received to the satisfaction of your company

If this account is placed for collection or any legal expense is incurred to enforce any of our rights or claims, applicant agrees to pay all costs thereof, including attorney's fees in the maximum amount allowed in the state of the applicant or the business, but not less that 15% of the outstanding balance when placed for collection. The applicant agrees: (1) this agreement shall be construed in accordance with the laws of the state of North Carolina: (2) Any dispute arising under this agreement shall be adjudicated in the state courts of North Carolina and waives any defense of inconvenient venue in said state.

I hereby personally, absolutely and unconditionally guarantee payment of any and all account, credit balances and debts of any kind, now or hereafter due and owing by the applicant to White's Tractor & Truck/White's International Trucks, it's successors and assigns. This guaranty shall be continuing and irrevocable for any such indebtedness. I hereby waive notice of default, nonpayment and notice thereof and consent to any modification or renewal of the credit agreements hereby guaranteed. If this guaranty is placed for collection or any legal expense is incurred to enforce or preserve any of our rights or claims, the undersigned agrees to pay all costs thereof, including attorney's fees in the maximum amount allowed in the state of the applicant or the business, but not less than 15% of the outstanding balance when placed for collection.
